If you register on our Website, GPS will provide you with (or you will select) a login ID and unique password to access the Website. You agree to:

GPS reserves the right to suspend, or to refuse any further, access or use of the Website if GPS learns or reasonably suspects that your registration information is false or inaccurate, if you refuse to provide complete and updated registration information, after extended period of inactivity by you, if you use your membership in a manner that is fraudulent or unlawful or violates our agreements with suppliers, or if you misuse or permit another to use your login ID or password who is not authorized to do so or for any other breach of security. You acknowledge and agree that you are responsible for maintaining the confidentiality of the password and that you (and not GPS) are liable for any harm that may result from your disclosing (or allowing the disclosure of) your password or other breach of these Terms.

MEMBERSHIP AND PAYMENT

By completing the membership registration process, you authorize GPS to charge automatic recurring membership fees to your designated billing payment method on a pre-paid annual basis. Prices and services are subject to change without notice.  Your membership will continue on a yearly basis until you cancel your membership or we terminate it. If you wish to change your designated payment method, you may do so by logging into your membership account and updating your profile. If you have any questions or concerns regarding your membership or billing, please contact our Membership Department at (800) 360-2808.

If you are responding to a promotional offer that contains different terms than those contained in these Terms, the terms of the promotional offer will be controlling.

CANCELLATION

You may cancel your membership in writing by logging into your member account and completing the “Contact GPS” form. If you choose to cancel your membership, we will refund your membership fee on a prorated basis by month. For example, if your membership begins in January and you terminate your membership on any date in August, we would then refund four months of your membership fee to you.

THIRD PARTY LINKS

Any third party links on the Website are not under the control of GPS and GPS is not responsible for the contents of any linked site, any link contained in a linked site, or any changes to such site. This includes the links to our suppliers’ websites contained in the password-protected portion of our Website. GPS provides these links to you as a convenience and not as an endorsement by GPS.

APPLICABLE LAW AND DISPUTES

You agree that the laws of California, without regard to conflicts of laws provisions will govern these Terms and any dispute that may arise between you and GPS or its affiliates. You agree that any dispute arising from this Website or GPS’ services shall be brought in the appropriate federal or state court in Orange County, California. If any legal action is necessary to enforce these Terms, the prevailing party shall be entitled to reasonable attorneys’ fees in addition to any other relief to which that party may be entitled. If any provision of these Terms shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
